Party A and Party B agree to handle this tourism matter in accordance with the following provisions:


Article 1 (Definition of Domestic Tourism)


The term "domestic travel" in this contract refers to travel within the territory of our country in Taiwan, Penghu, Kinmen, Matsu and other free areas.


Article 2 (Definition and content of individual tourism)


The term “individual travel” in this contract refers to: Party A requires Party B to arrange domestic transportation, accommodation, and travel itineraries; or Party A participates in the individual travel products of the transportation, accommodation, and travel itineraries packaged and sold by Party B.


Article 3 (Contents of scheduled tourist destinations and transportation and accommodation)


The transportation, accommodation and travel itinerary of this tour are detailed in the attachment.


The records in the preceding paragraph can be replaced by the advertisements and publicity documents published, which are regarded as part of this contract. If the records are for reference only, the records are invalid.


Article 4 (Assembly and departure time)


Party A should assemble and depart on time on the date and time of the Republic of China. If Party A fails to arrive on time and is unable to set off, and fails to join the tourist on the way, it shall be deemed that Party A has rescinded the contract, and Party B can deal with it in accordance with the provisions of Article 11.


Article 5 (Tourism Expenses and Contents Covered)


Total travel expenses: NTD, Party A shall pay according to the following agreement:


1. When signing this contract, Party A shall pay a deposit of NT$.


2. The remaining amount should be paid three days before departure.


The travel expenses paid by Party A in accordance with the preceding paragraph shall include the transportation expenses, hotel accommodation expenses and travel expenses listed in this contract that should be arranged by Party B. However, if the two parties agree to include other expenses, such agreement shall be followed.


Article 6 (Invalidity of Payment of Travel Expenses)


If Party A fails to pay the travel expenses due to reasons attributable to Party A, Party B may terminate the contract and confiscate the deposit paid. In case of other damages, compensation may be requested.


Article 7 (Passenger Cooperation Obligation)


If the travel needs the behavior of Party A to be completed, and Party A does not act for it, Party B may set a certain period of time and urge Party A to do so. If Party A fails to act within the time limit, Party B may terminate the contract and claim compensation for the damages arising from the termination of the contract.


Article 8 (Compulsory Insurance)


Party B shall handle liability insurance and performance guarantee insurance in accordance with the regulations of the competent authority.


If Party B fails to apply for insurance in accordance with the provisions of the preceding paragraph, in the event of a travel accident or inability to perform the contract, Party B shall compensate Party A with the minimum insured amount stipulated by the competent authority to calculate three times the amount to be claimed.


Article 9 (Cannot make the trip due to the negligence of the travel agency)


When Party A's tourism activities cannot be carried out due to reasons attributable to Party B, Party B shall notify Party A and explain the reasons immediately upon learning that the tourism activities cannot be carried out. If the notice is neglected, Party A shall compensate Party A for the liquidated damages calculated according to all the travel expenses; if the notice has already been made, Party A shall be compensated for the breach of contract according to the length of the notice arriving at Party A and the departure date and time according to the following provisions gold.


1. Those who arrive within the 21st to 30th day before departure will be compensated for 10% of the travel expenses.


2. Those who arrive within the 11th to 20th days before departure will be compensated for 20% of the travel expenses.


3. Those who arrive within the 4th to 10th day before departure will be compensated for 30% of the travel expenses.


4. Those who arrive within one day to the third day before departure will be compensated for 70% of the travel expenses.


5. Those who arrive after the departure date will be compensated for 100% of the travel expenses.


If Party A can prove that the damage it suffered exceeds the standards in the first paragraph, it may claim compensation for its actual damage.


Article 10 (Implementation and Exceptions of Tour Contents)


Party B shall handle accommodation, transportation, travel itinerary, etc. as stipulated in the contract, and shall not be changed. However, if Party B agrees to Party A's request and agrees to make changes, this is not the case, but the additional expenses shall be borne by Party A.


Party B shall not make changes in any name or reason, unless there is the matter of Article 12 or 14 of this contract. If Party B fails to handle matters such as meals, lodging, transportation, etc. according to the level specified in this contract, Party A may request Party B to compensate for the difference of two double the liquidated damages.


Article 11 (Passengers may cancel the contract at will before departure)


Party A may notify Party B to terminate this contract before the tour starts, but shall pay the license fee and compensate Party B according to the following standards:


1. Those who arrive within the 21st to 30th day before departure will be compensated for 10% of the travel expenses.


2. Those who arrive within the 11th to 20th days before departure will be compensated for 20% of the travel expenses.


3. Those who arrive within the 4th to 10th day before departure will be compensated for 30% of the travel expenses.


4. Those who arrive within one day to the third day before departure will be compensated for 70% of the travel expenses.


5. Those who arrive after the departure date will be compensated for 100% of the travel expenses.


If Party B can prove that the damage it suffered exceeds the standards in the first paragraph, it may claim compensation for its actual damage.


Article 12 (Cancellation of the contract due to statutory reasons before departure)


If the whole or part of this contract cannot be performed due to force majeure or reasons not attributable to both parties, the whole or part of the contract may be rescinded without being liable for damages. Party B shall return to Party A the balance after deduction of the fees paid or all necessary fees paid for the performance of this contract. However, both parties should notify the other party and explain the reasons when they know that the tourism activities cannot be carried out; if they fail to notify and cause damage to the other party, they should be liable for compensation.


In order to maintain the safety and interests of this contract travel, Party B shall take necessary measures to facilitate the travel after the termination of the contract in accordance with the preceding paragraph (but if Party A does not agree, it may refuse to do so). Party A is responsible.


 


Article 12-(Cancellation of contract due to objective risk reasons before departure)


Before departure, if the travel agency travels to one of the tourist areas, if there is a risk of endangering the life, body, health and property safety of the traveler, the provisions of the preceding article may be applied mutatis mutandis. However, the party who cancels the trip shall compensate the other party according to % of the travel cost (no more than 5%).


 


Article 13 (Passenger terminates the contract at will after departure)


If Party A withdraws from the tour activities or fails to participate in the tour items scheduled by Party B after the tour activities start, Party B shall not ask Party B to refund the tour fee. However, after Party B withdraws from the tourism activities due to Party A, the expenses that should be saved or not required to be paid shall be refunded to Party A.


Article 14 (Changes in itinerary, accommodation and sightseeing items during the tour)


When Party A participates in the travel itinerary arranged by Party B, due to force majeure or reasons not attributable to Party B, when Party A is unable to perform the scheduled itinerary, accommodation or excursion items, etc., Party B shall provide necessary assistance with the attention of a good manager. .


Article 15 (Attribution of Responsibilities and Co-organization)


During the travel period, due to reasons not attributable to Party B, if Party A suffers damage by taking air, ship, train, MRT, cable car, automobile and other public transportation means, the service provider shall be directly responsible for Party A . However, Party B shall do its best to help Party A deal with it.


Article 16 (Other Agreement Matters)
